Maybe: You can't be denied because it's a pre-existing condition, but can be denied because it is felt the surgery is not a viable or needed treatment for the specific condition. And there are always appeal processes with any insurance plan in you and/or your doctor feels a surgery is needed and your insurance company disagrees.
