Probably not: Braces don't damage teeth. Not cleaning well allows bacteria to collect next to braces and bacteria make acids that damage teeth. Eating hard, sticky, chewy foods partially loosen braces allowing bacteria to get behind braces and harm teeth. Could there be contributory negligence?
