Virus: He may have another type of viral illness. If he has worsening symptoms, significant fever,chills,sweats or deep cough,you must persuade him to go for an urgent reexamination to check for bacterial complications that require antibiotic therapy.

Not exactly sure: What's going on, as it not clear who "he" is? Your father, relative, friend? And do you mean that "he" won't go back to the ER, as it's not clear what "they said I can't get him to go to the ER" means. If you are really worried about someone, and you think they require emergent help, then just call an ambulance and deal with the fallout later. Otherwise, try to contact "his" doctor for help.
