No risk, no worry: Apparently you're a health care provider of some sort? Even if the patient is known to have HIV, scratching with fingernails would not be likely to transmit HIV, even if it caused bleeding wounds. Without bleeding, for sure there is no risk. But you really should be discussing this incident with your supervisor or your office or hospital infection control personnel.
