28 days: Even though your cycles vary in general most cycles are 28 days. If by 40 days you haven't had a period do a pregnancy test or sooner if you have symptoms of pregnancy.

Why not fix?: It seems like there is a logical, simple solution -- start birth control to regulate your menstrual cycle and avoid pregnancy scares. This would solve the problem. Since your cycles are irregular by definition they are unpredictable. There is no way to define "late" if there is no predictable pattern. Solve the problem with birth control and avoid this unneeded stress.
