I noticed a test kit at my local store that uses an oral swab. i noticed a disclaimer about not to use it if the product was tampered with. what happens if someone had bought this item, used it then returned it and the store resealed it for sale?

It is against the law so I do not think the store will do that.

Like anything else that you buy, including groceries, anything that appears grossly tampered with should be returned to the store and will be replaced, that will help the store also manage its own merchandise properly. Do not use the test if you have reason to believe the test has been used before.
