Depends: Depends on the actual ingredients. Personally, if it contains FD&C colors or fluoride, I would not use it even if it was new. I consider fluoride a poison, although I am sure many dentists would disagree.

Safe/effective: Safe, yes. Effective, probably for about a year after the "use by" date. The longer the time span, the less effective the product.
