Rubber Bands: You must wear the rubber bands as directed by your orthodontist. Failure to do so may result in your teeth not moving as desired. Chances are very, very slim that you would swallow a rubber band. Even if you do, it should pass without consequence. Speak to your orthodontist.

Your fault: It's your fault the spaces are not closing. If you're only wearing elastics while awake, 16 hrs out of 24, that's only 66% compliance, a failing grade. Wear elastics 24/7, or EXACTLY as prescribed. "Medicine" doesn't work if you don't take it. Don't worry about elastic falling off: 1) Extremely rare, and 2) If elastic does fall of you will either spit it out or swallow it and it will pass.
