Yes, but not for: very long. You should try washing it with disinfectant soap just to be sure. If they accept returns, maybe the best thing to do is for you to return it and ask for another one in a sealed package.

No risk, don't worry: First, it is exceedingly unlikely that the company would repackage potentialy used toys without first sterilizing them. But why not call them and ask for reassurance? Second, HIV and all STD germs die when they dry out, so even if somehow a toy hadn't been cleaned, there would be no risk without visible contamination with wet fluids or blood.
