May the law never soften its stance against these scourges of society who are mostly untreatable.

If the younger person is a child or adolescent under 18, it's still illegal and the older person will be held responsible.  Generally kids behaving in this way -- if they truly do -- have been sexually abused by another adult previously.

Pedophilia cannot be excused by medical or mental health; the person is responsible.

This refers to: an unnatural sexual attraction to minors.   It is a Paraphilia, which is a classification of mental disorders in the DSM V.   This class also includes Voyeurism, Exhibitionism, Frotteurism, Sexual Masochism or Sadism, Fetishism and Transvestism.

It is more like: An addiction. It is very hard to treat and needs expert interventions . The perpetrator need to accept responsibility for the behavior, not try to blame a mental condition.

A sociopath: It doesn't matter so much the difference between perpetrators' preferences. They all gain something from sadistically harming others. I don't specialize in treating perpetrators. I typically work with the survivors. Perpetrators usually are without remorse and typically are not treatable. Confinement is the treatment of choice.
