A member asked:

Theoretically, is this considered statutory rape if the boy is 16?

A doctor has provided 1 answer

Statutory rape: Varies legally from state to state. In colorado, sex with someone under 15 by someone at least 4 years older or of someone 15 or 16 by someone at least 10 years older is sexual assault (statutory rape). So, if the boy is the actor, it would be statutory rape if the victim is 12 or younger. If the boy is the victim, it would be statutory rape if the actor is 26 or older. Check your laws.
