Yes and yes: It is less likely to be transmissable if no open lesions are present, but people do shed herpes simplex virus in the absence of open ulcers, and therefore transmission is conceivable. It is also possible to transmit to genitals with oral sex, but again, far less likely in the absence of open ulcerative disease.
