In the last few years i have got a number of dark patches just above my toes on both feet, they don't cause any problems but what's the cause?

Possible sun spots: They may be spots from minor sun damage if you have a loy of exposure. Could be related to venous status or diabetes.

More info: If legs a swollen then venous stasis are you diabetic? Overweight? High blod pressure? Are you able to wash the top of your feet with a washcloth and soap?
