Details matter. The penis is on the outside of the body, the vulva is on the outside of the body, and the vagina is inside the body. A penis touching a vagina is sexual activity, because it is touching in a sexual manner. If you using another definition of activity, then it's another conversation. As always, one can catch HIV from a person only if that person has viruses to pass on to you.
