Known Risk: You would have signed "informed consent" forms before having the procedure and that releases both from any liability for the damage that occurred. Everything comes with a risk and unless the docs were negligent in their treatment (unlikely) then you will have to pay to repair the damaged tooth yourself - it is unfortunate it occurred but even you admitted you knew the tooth had an issue.

Known problem: Although not frequent, the dental injuries do happen during the placement of a breathing tube for general anesthesia. Especially when the particular anatomy of the neck or throat or the obesity makes the process difficult. The anesthesiologists document on anesthesia evaluation paper, the condition of the teeth, especially the front ones. The ones with problems tend to suffer most injuries.
