Yes: If the orthopedic surgeon has an active license to prescribe medications. However the orthopedic surgeon has the discretionary right to decide what type of pain medication the doctor wants to prescribe or not.

Yes: if he has a valid medical license and DEA number he can. Now whether or not he feels you need or have a medical condition that warrants pain medications is an entirely different story. He may be saying he can't prescribe medications for you because you medically do not need them. Prescribing in that situation would be both against the law and unethical.

Any licensed MD with: a DEA LICENSE can do so. Chronic pain is taken care of by Pain clinics,& require a narcotic contract.
