Yes: The decision to donate organs is made by the legal next of kin of the deceased. One would hope the wishes of the potential donor are respected, if they are known. That is the reason people are asked to sign donor cards or driver licenses. However, next of kin do refuse organ donation on a daily basis in the United States for various reasons.

Depends on the state: In some states, the patient's wishes, if clearly indicated (as on a driver's license) are sufficient, and final, for organ donation, no matter what the family says. In most states, however, the family decides.
