Not necessarily: Having HIV is not necessarily a disability as many people can live quite long with treated HIV infection. Aids is a term that is used for someone who is hiv-positive but who has had a significant decline in their immune system (with a low CD4 count<200 or having an aids-defining opportunistic infection). Having aids, however, may make someone more likely to be disabled, but it really depends.

Yes and no: If you are not able to work due to the HIV infection then you may apply for disability benefits. It is a disease that has the ability to produce a disability. It has serious health ramifications and will result in death if not addressed by a qualified professional.
