Depends: By default the person must have HIV in order to transit the virus to someone else. There are several ways to test for HIV, the most common can take up to 6 months to be positive but nowadays there are certain ways to test where you can kno within 1-2 day of transmission if someone is positive. technically if you get the most sensitive test you could find out earlier than the person you got it from
