On screening tests: possibly, but not on the confirmatory tests. Any time testing is used for forensic purposes, where you can be excluded from a job, or fired, or have probation/parole revoked etc etc the initial screening test MUST be followed by a more sophisticated confirmatory test, which can tell the difference between a false and true positive. If they are not confirming the test, I would seek legal counsel.
