I am 10 weeks pregnant and my downstairs neighbor smokes marijuana. we can occasionally smell it. will it harm my sweet baby?

Not at all: It is wise to minimize exposure to all drugs and herbs in pregnancy, esp. The first trimester, but the amount that would be entering your body from smelling it from a distance is so minimal i would have no concern.
