Definitely uncertain: Life is full of uncertainties. If no person or doctor has ever seen a herpes rash on the person, then the only way to find out is to do a herpes type-specific (testing for type 1 and type 2) antibody test on the person. Otherwise, it's hard to guess.

Impossible question: No. There is no rule about infections with herpes. There is no guarantee that 'he has it'. If he was not tested prior to the relationship and he is positive there is also no guarantee that you gave it to him either. All adults should have the herpes blood test to know their status. All adults should repeat the test, if they were previously negative, before entering into a new relationship.
