After missing menses: If your contraception method allows for monthly cycles, about 4-5 days after you should have started menstruation, a home pregnancy test usually will be effective. If you are on something like depo-provera (every 3 month shot) then you won't have regular periods and it's best to wait about 3 weeks after sexual activity and take a home pregnancy test.

The package inserts or even the box for each test tend to let you know how sensitive they are or how early the earliest they can detect a pregnancy is. The answer to the second question is that if your test is positive the birth control failed. If in doubt your doctor can do a blood test.
