Is it child abuse to smoke marijuana around a new born?

Maybe: This is politics and it would seem very unlikely to harm junior. Definitions before the law vary. During the 1950's, we were ignorant and missed thousands of child homicides. Nowadays, laws are very strict and in my experience are applied capriciously and sometimes (in my experience) without common sense. Until cannabis is fully legal, keep it away from baby, and think about staying clear-headed.
