Possibly: Remaining sperm in the uretha from previous ejaculate is cleared by urination. So if he urinated in last 10 hrs (i would assume so), then the previous ejaculate is gone. Fyi, if you're asking because you're using the "pull out method" for contraception, this doesn't work that well!

Not effective: He will always have sperm in the ejaculation unless he has had a vasectomy. Even then it takes a while to use it up. You need to use an effective form of contraception from a trusted source. You can always get condoms or go to planned parenthood if you don't have other resources.
