Can i do anything legally (press charges) to a 8 year old for repeatly touching my 5 year olds privates? what do i do?

Child abuse: If you believe your child is being touched inapropriately you must call your pediatrician immediately. He/she will assist.

Call Child Services: Occasionally such activity is considered benign exploration in kids, but we draw the line if there is more than two years difference in age. I would look up your states child and family services number, or child abuse, whatever it is called in yur state and report the child.Often this is a reflection of someone in that childs environment that is abusing them.Your doc may assist you if you need.
