Psychological Damage: You need to have a baseline evaluation and perhaps objective testing of your psychological state before you started seeing the doctor, after that it appears you have subjective distress and you need to get more objective data. To be considered malpractice, it should be negligence of ommission or commission causing damge to you as a direct result of the treatment.
