Assuming that you are talking about oral herpes (HSV-1), not genital herpes (HSV-2). Oral Herpes (HSV-1) is transmitted by kissing, sharing cups, and any transmission of saliva. It is a common infection affecting about 67% of the adult population. It does not require that there be open sores to be transmitted. It can be treated with topical or oral antivirals such as Valacyclovir.

Herpes is spread by skin to skin contact. Anal, oral, and vaginal sex and kissing. If you touch a herpes sore and then touch your mouth, genitals, and eyes you can infect yourself. Sharing a beverage is not contagious. Herpes is most contagious when sores are open and wet.
