Yes: The margin of error in Ob ultrasound is 1 week in 1st trimester, 2 weeks in 2nd and 3 weeks in 3rd trimester. With an 8 week difference in coital timing, with two full cycles between, it should be easy to tell who the FOB is by obtaining the due date from the US. Hope that is pleasing news ;-)

Depends on the court: Paternity becomes a legal consideration when any question is raised. Two months of separation is an easy spacing to separate 2 prospective fathers but if anyone raises an objection the issue would require direct evidence acceptable in the courtroom. The NIPS (non invasive paternal screening) test can be done on mothers blood as early as 10 weeks & may be needed to clear the issue.
