Cultural issue: Some cultures would consider any partner genital to genital contact as the event that removes the label, regardless of penetration. Some would require some form of genital penetration. Since you can get a sexually transmitted disease with the event you describe, the answer may be irrelevant. If or when you show up with a STD, the label will not matter.
