See your gyn: Your obgyn can determine the gestational age by getting an ultrasound usually done around 6-7 weeks.

It is a legal matter: You can have a NIPP test run as early as 8 weeks of pregnancy.This examines fetal cells floating in your blood and tests them for paternity and or other tests if desired.This test is valid in court proceedings and will determine the issue. It could be either, but more likely #2, you might start with testing him first.
