Maybe: It is hard to make a case for missing early breast cancer. This is a very common area of case law since it may be possible to "look back" at old mammograms and get a doctor to say it was there. The issue here is not "missing" a diagnosis but whether or not the delay resulted in significantly lower chance of cure/survival. Often a dealy does not result in such a change legally.
