HSV contagious: Genital herpes most of the time is caused by an infection with HSV type 2, now more and more also with HSV type 1, coming from oral sex. Once an individual has been infected the virus harbors in that individual's tissues and every so often can cause an outbreak, e.g, cold sores or blisters in the private area. The partner can get infected during skin-skin contact, even in the absence of blisters.

Test during outbreak: Herpes is most commonly transmitted through sexual intercourse. The tests for herpes aren't perfect. They are most sensitive during an outbreak. If your partner isn't having an outbreak, the test may be negative, even though he is a carrier of the virus. If you have only ever had one sexual partner, that is probably where you caught it. If you have had more than one, its hard to know.
