Not always: small septums in the vagina and a few other issues are not always easily seen on vaginal exam. If the physician caused a vaginal deformation that would be more of a medico-legal issue. Just like physicians can't always hear a heart murmur with the stethoscope these issues aren't always overtly visible. You have to prove he/she was negligent and the negligence had a negative effect.
