Maybe: Hipaa was designed to prevent unwarranted sharing of health information electronically.  It rapidly expanded to absurd levels.  It inhibits communication among doctors and restricts clinical research.  It increases costs and annoyance. The government and insurance companies can trade this information without restriction.  The whole thing needs revision.

No: No. A durable power of attorney gives someone the right to make medical decisions on someone else's behalf. Implicit in that is the permission that he medical care must be discussed with that person who has the power of attorney. It would be a violation of hipaa to talk with people who were not involved in the patients care about the patient.

No: It is medically necessary for all people that work with patients with c. Difficile to be aware that they have it so that they can take the necessary precautions to prevent its spread throughout the facility. Also the aides must gown and glove to prevent acquiring the infection themselves.

Most poa's do not include language giving access to medical information. The child an ask their mother if she is willing to sign a disclosure form.

Secret insurance records do not exist as far as i know.
