In general: Once someone is diagnosed with genital herpes, they should always consider themselves able to transmit the herpes virus to any sexual partners, regardless if there is an active lesion or not. Using a condom can greatly reduce the risk of transmission.

Theoretically: Herpes virus is shed primarily when lesions are active, but unfortunately it is possible to transmit the virus even when there is no obvious lesions present.

Herpes is forever: You can shed virus and be contagious even when you are not having an outbreak. You can take a suppressive antiviral (acyclovir or valtrex) to reduce/prevent viral shedding. Discuss with your doctor.
