Maybe: Yes - criminally you can be prosecuted, though the law generally means you are positive and had clear intent to injure the other person. But not telling about HIV is a felony in 27 states. Civil lawsuits also are possible - look at michael vick and rock hudson - and usually involve charges of fraud, negligence or intent.
