Probably yes: If your goal is intimacy, there is no reason not to do it at this time. If your goal is some aspect of using the cycle to prevent pregnancy, then there is a moderate risk of getting pregnant by having sex at this time.

Safe from what: Pregnancy has been documented from exposure during any day of a woman's cycle, including during menses. It is much less likely at that time if you have regular cycles, but not completely without risk of pregnancy. It certainly doesn't free you from risk of STD's.
