The only ways to tell if you have a herniated disc are based upon imaging tests, and to have your surgeon actually review the films (reports may not be accurate).
Those tests can be MRI or ct scans, and sometimes with a test called a myelogram. On physical exam or with nerve testing, a possibility of a herniation can be raised, but should not be considered a definitive diagnosis.
