CP is a devastating condition for the family to deal with and unfortunately the family almost always blames the obstetrician's error as causing this problem. Many of these children have had intra-uterine insults due to maternal medications, illegal drugs, alcohol etc.

A prospective study of 100,000 pregnancies by the NIH specifically designed to determine the cause of cerebral palsy lead to the surprising discovery that hypoxia did not cause cerebral palsy. The causes were all prenatal.

Actual birth trauma can occur such as what occurs during a delivery where the shoulder are stuck. Of course, to avoid birth injury at all, there could be an argument made for 100% cesarean section rate. The c section rate in brazil approaches 90% for a variety of reasons.

They found more than half the kids with CP (brain injury) had normal pregnancies,labors and deliveries with normal APGAR scores. TV adds are a fishing expedition by lawyers who will try to prove negligence, then bill for time and take 1/3 of any money retrieved. Its a job.

It is now clear that with IVF putting more than one embryo in the uterus is negligent. Allowing a fetus it to be delivered at 10+ pounds is also negligent--they are at significant risk of injury. Cerebral palsy varies enormously in severity and is not due to birth asphyxia. Shoulder dystocia may lead to Fx.
