Not true: People with herpes can spread it even if there is no outbreak or if you do not touch the outbreak area. Use condoms for better protection, but even they are not 100%. Read this from the CDC:

Possible to get HSV: Visible HSV lesions are infectious but just covering the lesion may not be sufficient to prevent HSV transmission if there is also infectious virus on nearby skin. Avoiding close skin contact when there's a definite HSV outbreak, using condoms at other times & the person taking antiviral meds all significantly reduce HSV transmission. ...Read more

Herpes: Herpes is caused by a virus that can lie dormant in the body for years. Because of this, you can catch it from someone who has never even had any symptoms. Since you had a negative test in june and a positive test now, it's safe to say you probably contracted herpes sometime between then and now, but when and from who cannot be determined. Either partner could have transmitted it to you and your outbreak would not have necessarily coincided with when you contracted it.
