Can I prove negligence in a medical malpractice case?

Difficult: Lawyers operate under the presumption that we would all live forever were it not for the wrongful interventions of medical practitioners. They only have to demonstrate damage and appeal to a jury of the loosest connection between the intervention and the 'bad' outcome. Negligence is hinted at, but rarely is definitive. Why would a psychotherapist put in your medical record serious diagnoses that were never shared face-to-face. Is this ethical?

Why would a psychotherapist put in your medical record serious diagnoses that were never shared face-to-face. Is this ethical?

It isn't necessarily: Unethical. I don't always share all of person's diagnoses with them at the time of initial diagnosis. Why? Because it can be overwhelming. It can be traumatic. I try to pace sharing in a way that is therapeutic. "first do no harm." I do consider sharing a diagnosis with the patient ; teaching them about it to be very important. Have you asked the psychotherapist about this? Sometimes when a >. ...Read more

Medical records. Is there any way to obtain my medical records?

Medical records. Is there any way to obtain my medical records?

Each : Each doctor's office or hospital has different policies regarding this matter, however your medical records should be made available to you in a timely fashion. Most facilities merely require a signed authorization, usually to be signed in person. If the records are in another state they may have another method for obtaining them. Remember you have a right as a patient to have access to your medical records. This includes all labs, x-rays, and clinic notes. Another method of obtaining medical records would be to have your current primary provider request to have your records released to them, which also requires your signature, this tends to be a little quicker in most case. Where do researchers get subjects for child abuse research? Who consents? What child agrees to be abused while research is conducted?

Why do medical studies sometimes contradict others?

Why do medical studies sometimes contradict others?

Media & flaws: The media never reports medical studies accurately. All retrospective (memory-based) studies are flawed by their very nature. For example, the last big study on meat-eating showed heart benefits for white meat (never reported) & if respondends maybe shaded tobacco / exercise questions by 5%, red meat would have no effect. In medicine we try to muddle through & give the best guidance we can. ...Read more
