Hello. I am assuming (but not sure) that the tattoo artist, scratches his genitalia through clothing. Now, if he is coming in to direct contact with his penis (i.e., by placing his hands down into his pants) and this is a mastabatory activity, then there is a possibility he could have pre-ejaculate or other discharge on the gloved hand. In that case, if there is a brief period from contact with his penis to touching tattooed areas, it would be conceivable that he could transmit infections.
However, if he is just scratching in the area that is covered by clothing, than he might only be potentially spreading possible germs that are on his clothes.
I would hope that he washes his hands well (or uses a disinfectant) between all customers and that he changes gloves between customers. I don't know if tattoo'ing requires actual sterile technique.

Unless you have direct contact with the herpes lesion your risk is extremely low. If she does not have a history of oral herpes you should be fine to kiss her, and her breasts are likely free of lesions.
The safest course of action is to always use condoms since research has shown that low levels of the virus can be present in the genitalia when there is no active lesions.
