Yes: Ejaculation is a sympathetic nervous system event and once those nerves have reached their target of excitation, you can not prevent the release. Some people think that by pressing and squeezing at the tip of the penis will prevent that, but that is not true. A back flow of sperm into the ejaculatory ducts, urethra and even baldder may occur.

Possibly: Remaining sperm in the uretha from previous ejaculate is cleared by urination. So if he urinated in last 10 hrs (i would assume so), then the previous ejaculate is gone. Fyi, if you're asking because you're using the "pull out method" for contraception, this doesn't work that well!
