Story not right: Er docs don't do surgery (except suture lacerations, drain abscesses, etc.) in a true emergency (think of a car accident when the patient is comatose) emergency surgery will be done if clearly appropriate. In most hospitals, this requires signatures from two physicians stating that surgery was required and that there was no one available to give informed consent.

Not nessecarily: It depends on the situation and the emergent nature of the procedure needed. It is always preferred, to have informed consent prior to doing anything, but under certain situations/emergencies a life saving procedure can be performed even if informed concent is not possible.
